Sinopsis

La presente crisis, con mayor incidencia que la anterior crisis financiera de 2008, ha puesto de manifiesto tanto la oportunidad, como la necesidad de contar con instrumentos de flexibilización como la cláusula rebus. Es más, se puede afirmar que la sociedad, en su conjunto, está respondiendo "en modo rebus", esto es, adaptando sus pautas sociales, económicas y jurídicas al cambio de circunstancias experimentado. La presente obra, de forma pedagógica y práctica, aborda el tratamiento de esta figura como una pieza clave de la modernización de nuestro Derecho contractual, delimitando su aplicación plenamente normalizada de acuerdo a su nueva configuración y concreción técnica.
